Adoption and surrogacy

Starting a family is not a straightforward journey for many couples. We can assist you in navigating the legal challenges faced with alternative pathways to parenthood, including surrogacy and adoption.

If you are considering surrogacy, we encourage you to consider the legal framework governed by the Surrogacy Act 2010 (Qld), which includes the following requirements: → The intended parents and the birth mother must consent to the surrogacy agreement. → The intended parents and the birth mother must be over 25 at the time of entering the agreement. → The intended parents must be residents of Queensland. → The intended parents and the birth mother must receive independent legal advice and counselling about the implications of the agreement. If you are considering adoption, we encourage you to consider the legal framework governed by the Adoption Act 2009 (Qld). A detailed handbook in respect of Adoptions in Queensland has been produced by Adoption Services and the link can be found in our Knowledge and Insights page. If you are considering alternative pathways to parenthood, we encourage you to reach out to discuss your specific circumstances with us.
